In the present case, the 2nd Chamber of the Administrative Court of Minden granted the complaint of a logistics company from Borgholzhausen at the oral hearing held on September 10, 2025. It had challenged the existing through-traffic prohibitions for trucks over 7.5 tonnes.
That closure was ordered in 2014 by the Gütersloh district on the basis of the air quality plan “Stadt Halle (Westfalen).” According to the information, the air quality plan had been prepared by the Detmold regional government in 2013. Earlier measurements had shown exceedances of the statutory nitrogen dioxide limit values. The main contributor to the nitrogen dioxide burden had been identified as heavy goods traffic.

Das klagende Logistik-Unternehmen gab nun an, dass die aufgrund der Sperrung erforderliche Umleitung die Fahrtzeiten erhöhe, wodurch ein finanzieller Mehraufwand entstehe – und dies führe zu einer existenziellen Bedrohung.
The lawsuit was granted: The plaintiff logistics company then stated that the detour required due to the closure would increase travel times, resulting in an additional financial burden — and this would lead to an existential threat.
Das Verwaltungsgericht Minden hat der Klage stattgegeben: Das angefochtene Durchfahrtsverbot könne im maßgeblichen Zeitpunkt der mündlichen Verhandlung nicht (mehr) auf den Luftreinhalteplan „Stadt Halle/Westfalen“ gestützt werden, so die Begründung. Die Verkehrs-Gegebenheiten, unter denen der Luftreinhaltplan aufgestellt worden sei, hätten sich durch den Lückenschluss der A 33 und die Fertigstellung
der „Entlastungstraße“ so gravierend verändert, dass eine Aktualisierung der Prognose notwendig sei.
The Administrative Court of Minden granted the claim: The challenged through-traffic ban could not (any longer) be based on the air quality plan “Stadt Halle/Westfalen” at the material time of the oral hearing, according to the reasoning. The traffic conditions under which the air quality plan was prepared had changed so significantly due to the completion of the A33 and the completion of the “relief road” that an update of the forecast was necessary.
Update required
Die Prognose im Luftreinhalteplan zur Belastungsentwicklung basiere hauptsächlich auf der Annahme, dass der Umfang des Schwerlastverkehrs auf der Langen Straße in Halle (Westfalen) fast unverändert bleibe. Laut Gericht sei diese Annahme jedoch mittlerweile überholt.
The forecast in the air quality plan for the development of the burden mainly rests on the assumption that the volume of heavy goods traffic on Langen Street in Halle (Westfalen) remains almost unchanged. According to the court, however, this assumption has now become outdated.
Man könne davon ausgehen, dass zumindest der überregionaler Schwerlastverkehr auch bei ersatzloser Aufhebung der Sperrung der Ortsdurchfahrt weiterhin zu erheblichen Teilen über die attraktivere A 33 abgewickelt würde.
It can be assumed
that at least supra-regional heavy goods traffic would continue to be routed largely via the more attractive A33 even if the through-traffic ban were lifted without replacement.
Zudem sei zu berücksichtigen, dass auch durch den Lückenschluss der A 33 ein erheblicher Teil des sonstigen Kraftfahrzeugverkehrs – der einen Anteil von rund 30 Prozent an den Stickstoffdioxid-Emissionen habe - aus der Innenstadt von Halle (Westfalen) verlagert worden sein dürfte.
Moreover, it should be noted that even with the completion of the A33, a substantial portion of the other motor vehicle traffic—accounting for about 30 percent of the nitrogen dioxide emissions—likely would have shifted from Halle (Westfalen)’s city center.
Aus diesem Grund sei eine erneute Prognose durch die Bezirksregierung Detmold erforderlich, die auf realistischen Annahmen über die voraussichtliche Verkehrsbelastung basiert.
For this reason, a new forecast by the Detmold regional government is required, based on realistic assumptions about the anticipated traffic load.
