Ruling of the Higher Regional Court
In 1987, the Higher Regional Court of Cologne ruled (Case No.: Ss 12/87) that headphones are not allowed while cycling if the volume is too high. The same applies when driving a vehicle: Loud music is taboo while driving.
The legal experts refer to the road traffic regulations: “Anyone operating a vehicle must ensure that their vision and hearing are not impaired.” (23 Paragraph 1).
Adjust volume
In principle, listening to music is allowed while cycling, driving a car or truck. However, the volume must be set so that ambient noises - such as ringing, honking, or sirens - can still be perceived.
Possible fine
If the music is turned up too loud, according to Arag experts, this may result in a fine of ten euros. The lawyers also point out that in the event of an accident, the use of headphones can even lead to shared liability and claims for damages or compensation for pain and suffering.
It is also forbidden to search for your favorite
song on your phone while driving - depending on the risk level, a fine of between 55 and 100 euros can be imposed, according to Arag.
